What is Khat?
Khat (Bath Salts) does not refer to any single drug, but rather a group of similar substances, chemically-made versions of a type of drug found in the Khat plant, an evergreen shrub from East Africa and southern Arabia. In the same way that Spice and K2 are referred to as synthetic marijuana, Bath Salts are referred to as synthetic stimulants. They can also cause hallucinations like that of LSD.
Bath Salts often contain a varied mix of chemicals, so even if the packaging looks the same, one never knows what the product actually contains. It is usually sold in powdered form in small plastic or foil packages. It can be white, off-white, yellow or brown and may also be sold in capsules or tablets, or in small jars in liquid form. Users usually snort or inject it, or mix it with food or drink. This can include “bombing” it (swallowing it wrapped in cigarette paper), taking it rectally, inhaling it using a vaporizer or smoking it. Other names can include: Arctic Blast, Cloud 9, Hurricane Charlie, Monkey Dust, Stardust, White Burn, or Zoom
What is the Punishment for Possession of Khat in Virginia?
Possession of Khat is a Class 5 Felony. The punishments may include:
1 year to 10 years in prison; and/or
1 day to 12 months in jail; and/or
A fine of up to $2500.00; and
A six month loss of your privilege to drive.
You can also be required by a court to complete drug treatment and probation.
If this is your first time being charged with a drug offense and it is for simple possession of Khat, you may be able to complete probation and drug treatment and have the Khat charge dismissed pursuant to Virginia Code Section 18.2-251.
Sentencing and punishment is often determined by a judge. If this is not your first offense, and you are found guilty by a judge, the court will consider Virginia Sentencing Guidelines for your Khat possession conviction.
What is the Punishment for Manufacturing or Distribution of Khat in Virginia?
Under Virginia Code Section 18.2-248(C), for a first offense conviction of Manufacturing with the Intent to Distribute Khat or Distribution of Khat, the penalty is:
A sentence between 5 and 40 years in prison; and/or a fine of up to $500,000.
If this is the second offense of Distribution of Khat, or any other Schedule 1 or Schedule 2 substance:
A minimum sentence of 3 years in prison with a possibility of 5 years to Life in prison and/or a fine of up to $500,000.
What is the Punishment for Possession of Khat with the Intent to Distribute?
Unfortunately there is not a difference for merely possessing Khat in Virginia with the intent to distribute and actually distributing Khat. The potential jail time is the same according to Virginia Code Section 18.2-248(C).
