Understanding Virginia Criminal Laws
Virginia has some of the strictest criminal laws in the country. The state classifies crimes into two main categories: misdemeanors and felonies. Knowing how the state categorizes your charge helps you understand what is at stake.
Misdemeanors in Virginia
While less severe than felonies, misdemeanors still result in a permanent criminal record, fines, and up to a year in jail. Virginia divides misdemeanors into four classes. Class 1 misdemeanors are the most serious, carrying a maximum jail term of 12 months and a fine of up to $2,500.
Common Class 1 misdemeanors include DUI, reckless driving, and assault and battery. Class 2 misdemeanors carry a maximum of 6 months in jail and a $1,000 fine. Class 3 and Class 4 misdemeanors result in fines only, reaching up to $500 and $250, respectively, but they still appear on your record.
