Understanding Virginia Laws Governing Juveniles 

Virginia laws treat juvenile offenders differently from adults, primarily focusing on rehabilitation rather than strict punishment. The Juvenile and Domestic Relations (J&DR) District Court handles cases involving minors under 18. 

Under Virginia law, the intake process is a highly significant step. When a minor is accused of a crime, a court intake officer reviews the complaint. For many minor or first-time offenses, Virginia law allows the intake officer to divert the case away from formal court proceedings. This diversion might involve community service, counseling, or restitution. If your child completes the diversion program successfully, the charges are dismissed. 

However, for more severe offenses, the intake officer will file a formal petition. In these instances, the case proceeds to an adjudicatory hearing, the juvenile equivalent of a trial. If the judge finds the minor guilty, the case proceeds to a dispositional hearing to determine the penalty. Possible penalties under Virginia law include probation, suspension of driving privileges, fines, or commitment to the Department of Juvenile Justice. 

It is also important to note that Virginia law allows courts to transfer certain serious cases to adult court. If a child is 14 years of age or older and faces severe felony charges, prosecutors may seek to try them as an adult. This makes early and aggressive legal representation absolutely necessary to keep the case in the juvenile system whenever possible.
